Fête Privacy Policy

  1. INTRODUCTION. This Privacy Policy (the “Policy”) explains how Fete Collective, Inc., a Delaware corporation (“Company”, “we”, “our”) collects, uses, and discloses personal information through its website (the “Site”) and its online e-commerce platform (the “Platform”, and collectively with the Site, the “Services”).  Any capitalized terms that are not defined in this Policy are defined in our Terms of Service. 

  2. INFORMATION COLLECTED AND HOW WE USE IT.  As explained further in this section, you will have the opportunity to provide us with certain personal information. In addition, we may collect certain personal information automatically through your use of the Services. We will use this information to provide you with the functionality of our Services, to improve our Services, and to provide you with information about our Services. The rest of this section provides a more detailed explanation of the personal information we collect and how we use that personal information. 

    1. Voluntarily Disclosed Information. 

      1. Account Creation. When you create an account on the Platform, we collect your email address and password. You may also choose to provide personal information through integrations with third-party login services, such as Shop. 

      2. Product Purchases. To process your orders, we collect your name, email address, shipping and billing address, phone number, and gift recipient information (if applicable). This includes any message you provide for gift delivery. We use this information to fulfill your order, personalize the gifting experience, prevent fraud, and provide order-related communication. Your payment information is collected and processed directly by our third-party payment processor (e.g., Shopify Payments); we do not store or have access to this data (see Section 3.2 “Shopify Platform”). 

      3. Marketing & Launch Notifications. If you subscribe to marketing communications or launch announcements, we collect your email address (and optionally your name). We use this information to send you promotional messages, product updates, and other news. You may unsubscribe at any time using the link in our emails. 

      4. User Communications. When you contact us via email, our contact form, or other messaging tools, we collect the information you provide to respond to your inquiry. We retain this information until the issue is resolved or longer where required by law.

      5. Company Communications. If you provide us with your email address or other contact details, we may use that information to send you marketing communications, promotional offers, and updates about new features or products. You can opt out of receiving marketing emails by following the unsubscribe instructions in any message you receive.

      6. Gift Recipient Information. If you purchase a gift, we collect the recipient’s name, address, and your message. This information is used to fulfill the gift order and is retained only as long as necessary to complete delivery and resolve related issues.

    2. Automatically Collected Information. 

      1. Browser & Device Information. Whenever you interact with the Services, we automatically receive and record information on our server logs from your browser or device, which may include your IP address, browser type, operating system, and other device-related details. This information helps us ensure the security and functionality of our Services and improve performance.

      2. Cookies and Tracking Technologies. We use cookies and similar technologies to enhance your experience and understand how users interact with our Services. A cookie is a small data file stored on your device by your browser. Cookies allow websites to recognize your browser, remember preferences, and track activity. We use both:

  • Session cookies, which are deleted when you close your browser; and

  • Persistent cookies, which may remain on your device for up to 24 months to support features like analytics and saved preferences

Our first-party cookies, set via Shopify, collect information such as session ID, cart contents, browser type, and referring site. This helps us ensure secure checkout, improve site performance, and analyze aggregated traffic.

We also use cookies and related tracking tools from third parties such as Shopify, Google Analytics, and Meta (Facebook Pixel). These services help us measure website traffic and usage patterns, analyze how visitors engage with content across devices, improve marketing attribution and ad targeting, and optimize overall user experience, among other things. Some of these services may use web beacons or other tracking methods in addition to cookies. They may also collect data about your activity across third-party websites and services where you are logged into their platforms.

You can control cookie preferences through your browser settings. Please note that disabling cookies may impact core features of the Services, such as the ability to complete transactions or retain items in your cart.

  1. Purchase History. We maintain records of your purchases and order details. This allows us to manage returns, respond to customer service inquiries, and recommend relevant products. We retain this data as required for tax and accounting purposes, typically for 7 years.

  2. Analytics. We use Google Analytics to collect aggregated data on how users interact with our Services. This includes time spent on pages, user flow, and device type. Google retains this data according to its platform policies.

  3. Social Media and Marketing Engagement. If you interact with our content via social media or advertising platforms (such as clicking a Facebook or Instagram ad), we may collect data through those platforms to evaluate ad performance and audience engagement. This data is governed by the respective platform’s retention policies.

  4. Emails. We may receive a confirmation when you open an email from us. 

  1. DISCLOSURE OF INFORMATION.  We may disclose your personal information to the categories of third parties identified in this section.

    1. Personnel and Third Party Service Providers. We employ personnel and engage other companies and people to perform tasks on our behalf and need to share your personal information with them to provide products or services to you. These service providers may include:

  • E-commerce platform providers, for site hosting, checkout processing, order management, and analytics;

  • Payment processors, to securely handle transactions;

  • Marketing and communication platforms, to manage and send promotional emails, SMS messages, and site updates;

  • Analytics providers, to help us understand website usage and improve performance;

  • Advertising platforms, to measure ad effectiveness and deliver targeted promotions; and

  • Security and infrastructure providers, to support website performance, uptime, and fraud prevention.

  1. Shopify Platform. Our Site and payment processing run through the Shopify platform. You can learn about Shopify’s information collection and use practices at the following website: https://www.shopify.com/legal/privacy/customers

  2. Other Users. Please note that if you submit any personal information or Your Content to a portion of the Platform that is accessible by other users, including a comment section, those users will be able to see that personal information and Your Content. Accordingly, only include personal information and such portions of Your Content in such submissions that you are comfortable sharing with other users. 

  3. Advertisers.  We use Meta’s Pixel to understand how users interact with our site and to deliver more relevant advertisements. Meta may use cookies and tracking tools to collect browsing data and match it with users on Facebook or Instagram for retargeted ads or lookalike audience campaigns. Your email address may also be shared with Meta in hashed form as part of this process. We also use Google Ads tools that may collect cookie and usage data from our site to offer personalized ads through Google platforms. These tools help us understand ad performance and deliver targeted promotions based on user behavior 

  4. Analytics Services. As mentioned above, we use analytics tools, including Google Analytics and Shopify’s built-in analytics, to better understand how users interact with our Services and to improve performance. These tools may collect information such as your IP address, device type, browser details, and pages visited. You can learn more about how these services use your information at:

  1. Anonymous Information. We may de-identify your personal information so that you are not identified as an individual, and use such data for our internal purposes or share that information with third parties. We may also provide aggregate usage information to third parties (or allow these third parties to collect aggregate information of activity on our Services), who may use that information to understand how often and in what ways people use our Services, so that they, too, can provide our users with an optimal online experience. 

  2. Business Transfers. If we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, personal information could be one of the assets transferred to or acquired by a third party.

  3. Legal Compliance. We reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with governmental requests, law enforcement or court orders, or enforce or apply our Terms of Service and other agreements. 

  4. California Residents. If you reside in California, you have the right to ask us one time each year if we have shared personal information with third parties for their direct marketing purposes. To make a request, please send us an email at contactus@fete.com or write to us at the address listed at the end of this Policy. Indicate in your letter that you are a California resident making a “Shine the Light” inquiry.

  1. SECURITY. We use commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. For example, we enter into contracts with all of our third party service providers that require reasonable precautions be taken against unauthorized uses of your personal information. We rely on trusted third-party platforms, including Shopify and other integrated vendors, to store and process personal information. These platforms implement their own security practices to safeguard data. We cannot, however, ensure or warrant that these precautions will always be successful or that your personal information on the Services may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. 

  2. DATA STORAGE. We do not store personal information on Company-owned servers. All user data is securely stored and processed by our third-party service providers, including Shopify (our primary platform), Google Analytics, and other integrated vendors. These providers may store data on servers located in the United States or other jurisdictions.

  3. MODIFICATION, DELETION & RETENTION OF INFORMATION. If you wish to access, modify, or delete your personal information, you may contact us directly at contactus@fete.com. For email marketing, you may click “unsubscribe” at the bottom of any marketing email. Please note that full deletion of user data may require a manual request. We will retain personal information as long as necessary to fulfill the purposes outlined in this Policy, comply with legal obligations, or maintain business records. Please understand, however, that it may be impossible to delete this information completely, due to backups and records of deletions. In addition, we may deny a deletion request if (i) the denial is necessary for us to comply with applicable law, or (ii) the request pertains to content that you posted on a publicly available portion of the Services and that cannot be deleted without impacting the Services experience for other users. You may not request the removal of de-identified, anonymous, or aggregate data from our databases.

Subject to your right to request deletion of your personal information, we will retain your personal information as long as needed for your use of the Services, your approved receipt of marketing communications from us, our compliance with legal obligations, and to protect our or other’s interests.

  1. HOW WE RESPOND TO DO NOT TRACK SIGNALS. We will honor your exercise of your rights with respect to your personal information in accordance with Section 5. Apart from those rights, we do not respond to “Do Not Track” signals.

  2. AGE OF USERS. Our Services are offered and available only to users who are at least 18 years old. By using the Services, you represent to us that you are of legal age to form a binding contract with Company. If you are not at least 18 years old or otherwise do not have the legal capacity to enter into a contract, you must not access or use our Services. If we learn that we have collected personal information from a child under the age of 13, we will delete that information as quickly as possible. We do not knowingly market to or collect personal information from anyone under 13.

  3. CHANGES TO POLICY. We’re constantly trying to improve the Services, so we may need to change this Policy from time to time as well. The date of the last modification will be posted at the beginning of this Policy. It is your responsibility to check from time to time for updates. By continuing to access or use the Services, you are indicating that you agree to be bound by the modified Policy.
